The 3DS isn't bad for children, the 3D is. You can turn it off, you know.

So are 3D movies. doesn't stop parents from taking them to see Toy Story 3 in 3D.

A two hour movie is probably not nearly as bad as a game console a kid can play at any time, though.

The same warnings on the 3DS were on the N64.

Children under eight are not meant to watch TV, play video games, or use 3D devices. It's been known about for ages, it's just that every few years the warnings just vanish and people stop caring about future generation eye sight.
