The Select/Home/Start area looks like there is a light gray plastic on it. Is it supposed to be there, or do you peel it off?

Mine did not come with plastic on it... I would say you might have a bit of a problem.

Hold the start/home/select part in the light. You'll notice it.

having a massive hole with the 3 buttons and parts of the 3DS exposed to light,dust or anything in the air.
