Nintendo digital is 1000% safe (that's not a typo). No matter what you kids say, Nintendo can transfer your purchases from one serial number to another without having your 3DS present. This not only gets you all of your games, but is a big middle finger to the guy who stole your 3DS as once he goes online all of the previous purchases will deactivate and disappear.
Just because you're under 18 and aren't old enough to call customer support doesn't mean that customer support can't do it. It's not as efficient as PSN or XBL by any means, but it works and is safe. There is just an inconvenient extra step, that doesn't mean you lose it all.
I just want to know what kind of TV it was that was (pardon me for doing this) over nine thousand dollars. And that it's a she, too... I don't know many female gamers owning 200 XBox360 games. I'm not saying it's impossible, but it does seem unlikely.
I also know super expensive TVs exist, but if she paid that much for it, I imagine it was a while ago, and a replacement can be had for probably much closer to $2000 now.
