The update fixes a bug on Mount Pajamaja that can prevent you from proceeding under certain circumstances, as well as a bug in the final boss battle, and some other issues as well.
Stop reading my sig, you are wasting time doing so.

the gyro controls crap out on me.
You either die a hero or live long enough to see yourself become a villain. http://www.youtube.com/watch?v=CfDtJvYrFD4

There's people saying that one of the giant battles make the gyro controls gone weird, making impossible to avoid any attacks. I hope they fixed that (I am close to this part).

Is this patch only available if you download the game for the eShop? What if you bought a physical copy of the game?

Wasn't even aware this game had problems that required a patch. I've made it as far as Driftwood Shore and haven't run into anything weird. The most trouble I've had so far was against that stupid mammoth boss on Mt. Pajama, though that's probably more from me sucking at the game than any bugs or glitches.

But patching is bad, a lot of people told me so. Apparently, patching leads to lazy developers releasing unfinished games.

Sorry, patching is one of the things that I have to rail on. Good for Nintendo to stay consistent. Wagging my finger at Aksys for not fixing Zero Escape (is the eShop version fixed)?
